BMW Driver Faces Vehicular Assault Charge In Drunk Driving Head-On Crash, Police Say

A 28-year-old man who was allegedly driving while intoxicated during a crash that seriously injured another ma  has been charged with vehicular assault.

On Sunday, Nov. 25, the State Police arrested Carlos M. Aguilar Breton of Poughkeepsie for DWI following a crash around 8:10 p.m. on Route 55 west of Route 82 in the town of LaGrange, said New York State Trooper AJ Hicks.

At the time of the crash, Breton, who was driving a 2015 BMW 528i, struck a 2005 Subaru Legacy head-on. An investigation revealed that Breton was impaired by alcohol and in possession of concentrated cannabis at the time of the crash, state police said.

After further investigation, and the assessment of how serious the injuries sustained by the victim were, Breton was additionally arrested with vehicular assault and possession of concentrated cannabis.

The victim was transported to MidHudson Regional Hospital with serious but non-life threatening injuries.

Following his arrest, Breton was released and is scheduled to appear in court on Dec. 4.
